Terms and Conditions

Account Customers

Our Terms of trade are strictly 7 days from date of invoice. It is important to adhere to our terms in order that Prospectors Pty Ltd function in a viable and efficient manner. Customers with overdue accounts run the risk of their orders being delayed in dispatch.

Non Account Customers

Payment by credit card, cash or money order is required before goods are dispatched.

New Accounts

Applications for credit accounts are invited. Click  here for application form. This form gives details of all requirements to set up the account.

Delivery

Wherever possible goods will be dispatched within 24 hours after receiving your firm order. In most cases, if you order before 14:00 (2:00PM) AEST, Prospectors Pty Ltd will dispatch the goods the same day.

Registered Post
The weight of any one box sent by registered post cannot exceed 20kgs.

Parcel Post Plus
Available in 500g, 3kg and 5kg satchels. Delivery time of 1-5 working days. Delivery time is not guaranteed.

Inspection of Delivered Goods

Prospectors Pty Ltd require buyers to inspect all goods upon delivery and notify us within 48 hours if the goods are not in accordance with your order. Failing this, the goods shall be deemed to have been delivered to and accepted by you.

Insurance

Insurance cover will be affected by Prospectors for all goods dispatched by nominated carrier. If you do not require insurance cover please advice, in writing, prior to dispatch.

Back Orders

Prospectors Pty Ltd endeavor to maintain an adequate stock of all listed items. Occasionally Prospectors Pty Ltd are unable to supply from stock and it becomes necessary to place these items on back order. When this happens, you will be kept informed of the progress and the item(s) will be dispatched immediately upon receipt at our store.

Return of Goods

Goods that have been ordered and delivered, require prior authorization before return. Do not dispatch items for return without first contacting our office. You will be given a Goods Return Number.

Items must be returned in new condition and in original wrapping, packaging etc. All freight charges on incorrectly ordered goods are the responsibility of the customer.

No returns after 30 days from date of invoice.

Quotes

Unless otherwise indicated quotes are valid for 30 days. Quotes are not an obligation to sell and no contractual obligations will come from them until your order has been accepted in writing.

Passing of Property and Risk

Goods supplied by us to you become your property and risk immediately on delivery.

Supply

Prospectors Pty Ltd reserves the right to suspend or discontinue the supply of goods to you without prior notice. Prospectors Pty Ltd reserves the right to cancel any order made by the buyer without prior notice. 

Shipping of Dangerous & Hazardous Goods

Prospectors Pty Ltd reserves the right to alter the shipping charge on any item on an invoice if the items purchased are deemed to be Dangerous & Hazardous Goods. These items have to be shipped via alternate methods and incure additional costs.

Part Deliveries

Prospectors Pty Ltd reserve the right to make part deliveries of your order, and each part delivery is considered a separate sale as per these terms and conditions. A part delivery of an order shall not invalidate the balance of an order.

Installation

Our goods are supplied on a supply only basis. Any installation fee is at your expense.

Manufacturer’s Changes and Descriptive Details

All descriptive details are provided as approximations and subject to change without notice. Manufacturers specifications are subject to change without notice.

Prospectors is not responsible for any loss or damage incurred due to incorrect description of goods.

Currency

Any adverse variation in the price due to exchange rate fluctuation will be to your account.

Contingencies

Prospectors Pty Ltd cannot be held responsible for any charge, sales tax, levy or other expenditure which is not applicable at the date of quotation/invoice but is later charged to you.

Charges Beyond Point of Delivery

You are responsible for all charges incurred after the point of delivery.

Force Majeure

If our ability to meet our obligations to you is impeded by situations beyond our reasonable control (such as, but not limited to, natural disaster, raw material shortage, strike, industrial action, breakdown of transport or plant etc) Prospectors Pty Ltd can, at our discretion, inform you of any holdups. Prospectors Pty Ltd cannot be held accountable for delays that occur because of reasons beyond our control.

Default

If any of these terms are not met Prospectors Pty Ltd reserve the right to stop supply. Prospectors Pty Ltd are not responsible for any loss or damage that may occur because of this.

Order Cancellation

Unless otherwise agreed in writing, you cannot cancel an order that has been accepted by us. If a right of cancellation is expressly reserved by you, this must be exercised by notice in writing no later than 7 days prior to the estimated date of shipment. Unless otherwise agreed on cancellation prior to shipment any deposit paid by you shall be forfeited.

Warranty

Prospectors Pty Ltd makes no exception to the extent that the goods supplied are covered by the manufacturer’s warranty and Prospectors Pty Ltd will pass on to you the full benefit of the manufacturer’s warranty. If you find any defect in the goods supplied by Prospectors Pty Ltd you must notify us immediately (within 7 days) in writing. You can not carry out any repair work to allegedly defective goods without first obtaining written consent from us.

Changes to the Conditions

Prospectors Pty Ltd reserves the right to change these terms and conditions at any time without notice.

Governing Law

These terms and conditions and all contracts that include them are governed by the laws of the State of New South Wales.
